Welcome to Mat & Moov. These Terms of Service (“Terms”) govern your use of our website, online store, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services or purchase products from our store.

The Services are operated by Mat & Moov and hosted through Shopify, which provides the ecommerce platform that allows us to sell our products and services to you.

Use of the Services

By using our Services, you confirm that you are at least the age of majority in your jurisdiction or have consented for any minor dependents to use our Services under your supervision. You agree not to use the Services for any illegal or unauthorized purpose and not to violate any applicable law while using our website. You may not transmit viruses, malware, or other harmful code. Violation of these rules may result in termination of access to the Services.

Product Information and Availability

We make every effort to ensure product descriptions, images, and pricing are accurate. However, Mat & Moov does not guarantee that all information is error-free, complete, or current. We reserve the right to modify or discontinue products at any time without notice. Quantities may also be limited.

Pricing and Payments

All prices are subject to change without notice. Payments are processed securely through third-party providers integrated with Shopify. By submitting payment, you represent that you are authorized to use the chosen payment method. We reserve the right to refuse or cancel orders if fraud or unauthorized activity is suspected.

Orders, Pre-Orders, and Billing

Once an order has been placed, it cannot be canceled or changed. All orders are final, and we encourage you to review your order carefully before checkout.

For pre-orders, you acknowledge that the items will ship on or after the estimated production/shipping date listed on the product page. Pre-order timelines are estimates and may change due to production or shipping delays. By placing a pre-order, you agree to wait for delivery without requesting refunds or cancellations.

No Returns and Refunds

All sales are final. Mat & Moov does not accept returns, refunds, or exchanges.

If a product arrives damaged or incorrect, you must contact us within 48 hours of delivery with photos of the product and packaging. We may, at our discretion, offer a replacement or store credit.

Mat & Moov is not responsible for lost or stolen packages once marked as delivered by the shipping carrier.

Shipping and Delivery

Shipping times are estimates and may vary based on carrier performance, weather, or other factors outside of our control. Once an order is shipped, delivery times are determined by the carrier.

Intellectual Property

All content on the website, including logos, product designs, graphics, text, and images, is the property of Mat & Moov and may not be copied, reproduced, distributed, or used without permission. Unauthorized use may violate copyright, trademark, and other laws.

User-Generated Content and Feedback

If you submit ideas, suggestions, reviews, feedback, or other content (“Feedback”), you grant Mat & Moov a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium, including commercial purposes.

By submitting Feedback, you represent that you own the rights to it, that it complies with applicable laws, and that it does not violate the rights of any third party. We may, but are not required to, monitor, edit, or remove Feedback that we determine violates these Terms. You are solely responsible for your Feedback and its accuracy.

Mat & Moov may also collect and repost user-generated content from social media, including:

tagged photos
workout videos
influencer posts

By interacting with our social channels or using our products in content you post publicly, you grant Mat & Moov permission to use that content in our marketing and promotional materials.

Disclaimer of Warranties

The Services and products are provided on an “as is” and “as available” basis. Mat & Moov makes no representations or warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, or non-infringement. We do not guarantee uninterrupted or error-free use of the Services.

Limitation of Liability

To the fullest extent permitted by law, Mat & Moov, its affiliates, partners, employees, agents, service providers, licensors, and Shopify shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the Services or products purchased through the Services, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Mat & Moov, its affiliates, partners, officers, directors, employees, agents, licensors, service providers, and Shopify from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from:

your breach of these Terms
your violation of any law or third-party rights
your misuse of the Services

We may control the defense and settlement of any claim, but will not settle claims requiring non-monetary obligations from you without your consent.

Governing Law

These Terms shall be governed by and interpreted under the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes must be resolved in the courts of New Jersey.

Changes to Terms

We may update these Terms at any time. Updated Terms will be posted with a revised “Last Updated” date. Continued use of the Services after changes constitutes acceptance of the updated Terms.
